What happens after a DUI arrest in Wichita?

Three agencies make most DUI arrests here: the Wichita Police Department, the Sedgwick County Sheriff and the Kansas Highway Patrol. All of them bring adults to the same building. The Sheriff states that the detention facility books people for every city in Sedgwick County, so a DUI arrest in Derby, Haysville, Maize or Park City ends up at 141 W Elm too.

Six steps after a DUI arrest in Wichita, from booking at 141 W Elm to the first court date
  1. Stop and arrest. The officer asks for field sobriety tests and a preliminary breath test, then makes the arrest.
  2. Booking. Staff take a photo, fingerprints and property. The evidential breath or blood test is done after arrest.
  3. Bond is set. The court controls the amount, the type and the conditions.
  4. Bond is posted. A bondsman, or anyone paying the full amount in cash, posts the bond at the jail.
  5. Release. The person is released from the jail at 141 W Elm.
  6. First court date. The date is written on the bond paperwork.

How does a DUI bond work at the Sedgwick County Jail?

There are three ways out after a DUI arrest.

Way out What it costs Who it fits
Own recognizance (OR) No fee Local residents the booking sergeant approves
Surety bond through a bondsman At least 10% of the bond Most people with a set bond amount
Cash bond The full bond amount People who can pay it all and wait for a refund

An OR bond is a signed promise to come to court. The Sheriff limits it to people who live in the metro area, which the county lists as Sedgwick, Harvey, Butler, Sumner, Reno and Kingman counties. There is a DUI rule on top of that. A person arrested for DUI must wait until a sober adult picks them up or until the sergeant decides they can function alone, and the sergeant may watch them for up to four hours.

When OR is not offered, a DUI bond is posted as a surety bond or in cash. Our guide to OR bonds in Sedgwick County covers who qualifies.

How much do DUI bail bonds in Wichita cost?

Kansas law sets the floor. Under K.S.A. 22-2809b, a bail bond company must charge a premium of at least 10% of the face amount of the bond, and at least half of that minimum must be paid before the bond is posted. The rest can go on a written payment agreement.

Bond amount Minimum premium (10%) Minimum due before posting
$1,000 $100 $50
$2,500 $250 $125
$5,000 $500 $250
$10,000 $1,000 $500

The premium is the fee for the service. It is not refunded when the case ends. The court decides the bond amount in each case, so call us with the name and date of birth and we will read you the exact figure from the jail record. You can also check it yourself on the Sedgwick County inmate search. If money is tight, see how bail bond payment plans in Wichita work.

What are the penalties for a DUI in Kansas?

K.S.A. 8-1567 makes it a crime to drive with a breath or blood alcohol level of 0.08 or more, or while too impaired by alcohol or drugs to drive safely. The level counts if it is measured within three hours of driving.

Conviction Class Jail Fine
First Class B misdemeanor 48 hours to 6 months, or 100 hours of public service $750 to $1,000
Second Class A misdemeanor 90 days to 1 year $1,250 to $1,750
Third Class A misdemeanor, or a level 6 felony with a prior in the last 10 years 90 days to 1 year $1,750 to $2,500
Fourth or later Severity level 6 felony Set by the sentencing grid Set by the court

Bond amounts usually climb with each prior conviction, because the judge looks at criminal record and past court appearances under K.S.A. 22-2802. A felony DUI is always heard at the Sedgwick County Courthouse, 525 N Main. A DUI written under a Wichita city ordinance is heard at Wichita Municipal Court in City Hall, 455 N Main. Our Wichita Municipal Court bonds page explains the city side.

The 14 day license deadline most people miss

The criminal case and the driver’s license case are separate. When a driver fails or refuses the test, the officer serves a notice of suspension. K.S.A. 8-1020 gives the driver 14 days from that notice to ask the Kansas Division of Vehicles for an administrative hearing, with a $50 fee. A request made on time keeps the temporary license in place until the hearing is decided. Miss the 14 days and the suspension starts as written on the notice.

Getting out of jail fast matters here. Every day in custody is a day off that 14 day clock.

After a suspension, many drivers need an ignition interlock device before they can drive again. We keep a local list on our ignition interlock in Wichita page.

What to have ready when you call a bondsman

  • Full legal name and date of birth of the person in jail
  • The bond amount, if you already looked it up
  • Your photo ID and a working phone number
  • A way to pay at least half of the 10% premium: cash, card or electronic transfer
  • The name of a sober adult who can pick the person up at 141 W Elm

Kansas law also requires the bondsman to be physically present at the jail to sign the bond. Being three blocks away on North Broadway is the reason we can do that quickly at 3 a.m. on a Saturday.

Frequently asked questions

Do you always go to jail for a DUI in Kansas?

An arrest means booking, but not always a long stay. Many first time arrests end in an OR release or a bond within hours. A conviction is different. A first conviction carries at least 48 consecutive hours in jail or 100 hours of public service under K.S.A. 8-1567.

Is your license suspended right away after a DUI arrest?

No. The officer’s notice works as a temporary license, and you have 14 days to request a hearing under K.S.A. 8-1020.

Can a first DUI be handled with diversion in Sedgwick County?

Sometimes. Kansas allows one DUI diversion in a lifetime, and the District Attorney decides who gets it. A lawyer can tell you whether you qualify. We can refer you to local attorneys.

How much does a $1,000 DUI bond cost?

The legal minimum premium is $100, with at least $50 paid before the bond is posted.

Can I bail out someone arrested for DUI if I live in another state?

Yes. Kansas law lets a bondsman accept a card payment or an electronic transfer for the premium, so you do not have to be in Wichita. Call us and we will go through the paperwork with you by phone.
