Do you get your bail money back when charges are dropped in Kansas? It depends on how the bond was paid. Cash posted with the court is returned, less any costs or fines. Collateral given to a bondsman is returned once the bond is discharged. The premium paid to a bondsman is not refunded, because it was the fee for getting the person out, and that service was delivered the day the bond was posted. The rest of this page explains each one and the steps to take after a dismissal in Sedgwick County.

Do you get bail money back when charges are dropped?

| How the bond was paid | What happens after dismissal | Law |
|---|---|---|
| Full cash bond at the jail or court | Refunded, minus outstanding restitution, costs, fines and fees | K.S.A. 22-2802 |
| 10% cash deposit with the court clerk | Refunded on the same terms | K.S.A. 22-2802 |
| Own recognizance | Nothing was paid, so nothing is owed | K.S.A. 22-2802 |
| Surety bond through a bondsman | Premium is kept. Collateral is returned | K.S.A. 22-2809b |
Answer 1: cash comes back
K.S.A. 22-2802 says a person who posts a cash bond and makes every court appearance is entitled to a refund of the money after the case is finally disposed of, less restitution, costs, fines and fees that are still owed. A dismissal is a final disposition.
Two local details from the Sedgwick County Sheriff:
- The receipt for a cash bond is issued in the name of the person who paid, with the inmate listed as the beneficiary. The refund follows the receipt, so keep it.
- The Sheriff’s Office cannot refund a cash bond once it is posted. The court that received the bond decides what happens to it.
For a District Court case, ask the clerk at 525 N Main, 316-660-5900. For a Wichita city case, the Municipal Court clerk’s office on the 2nd floor of City Hall, 455 N Main, has a cash bond refund form.
Answer 2: collateral comes back
If you signed over a car title or gave other collateral, the bondsman has to return it when the bond is discharged and the account is settled. K.S.A. 22-2809b lists intentionally failing to return collateral when it is due as a ground for a court to suspend or end a bondsman’s authority. See bail bond collateral in Kansas.
Answer 3: the premium does not come back
A premium is not a deposit. It is the price of the bond. The bondsman took on the risk of the full bond amount and went to the jail to sign for the release. That happened whether the case lasted two years or two days.
Kansas law also sets a floor. K.S.A. 22-2809b requires a premium of at least 10% of the bond, and failing to charge that minimum is a ground for suspension. A bondsman who handed premiums back after dismissals would be charging less than the law requires.
| Bond | Minimum premium | Refunded if charges are dropped |
|---|---|---|
| $1,000 | $100 | $0 |
| $5,000 | $500 | $0 |
| $10,000 | $1,000 | $0 |
If you are on a payment plan, the balance is still owed after a dismissal. The payment agreement is a separate contract from the criminal case. Our page on bail bond payment plans in Wichita explains the terms.
What does dropped actually mean?
The word covers four different situations, and the bond ends at a different point in each.
| Situation | What it means | When the bond ends |
|---|---|---|
| Prosecutor declines to file | No case is opened after the arrest | When the court releases the bond. Ask the clerk |
| Dismissed without prejudice | The case is closed but can be filed again | At dismissal. A refiled case means a new bond |
| Dismissed with prejudice | The case is over for good | At dismissal |
| Diversion | The case is paused while you complete a program | When the diversion is completed and the case is dismissed |
Diversion surprises people. The Sedgwick County District Attorney’s guidelines say the defendant stays on pretrial release bond for the length of the agreement. A DUI diversion term is 12 months. So the bond, the conditions and the cosigner’s liability all continue for that year, even though the case feels finished.
A dismissal without prejudice carries a different risk. If the prosecutor files again, a new warrant can be issued with a new bond, and a new premium would be due. The first premium does not carry over.
What should you do after a dismissal?
- Get it in writing. Ask your lawyer or the clerk for a copy of the order or the journal entry.
- Tell your bondsman. We check the court record and close the bond on our side.
- Ask for your collateral. Bring the receipt you were given.
- Claim a cash bond. Contact the clerk of the court that holds it, with your receipt and ID.
- Settle the premium balance. Ask for a statement showing what is still owed.
- Ask about the arrest record. A dismissal does not erase the record of the arrest. Our expungement in Wichita page explains how records are cleared.
A cosigner’s liability on the bond ends when the bond is discharged. Any unpaid premium the cosigner guaranteed is still owed. See how to get off a bond you cosigned.
Is cash or a bondsman the better choice if the case looks weak?
This is the question behind the question. If you think the charges will be dropped, cash looks better because it comes back.
| Cash bond | Bondsman | |
|---|---|---|
| Money needed today | The full bond | At least half of 10% |
| Back at the end | All of it, less costs and fines | None of the premium |
| Risk if a court date is missed | You lose the cash | You owe the bondsman under the contract |
| Money tied up | For the life of the case | No |
Nobody can know how long a case will take or how it will end. Tying up $10,000 for a year is a real cost for most families in Wichita. Paying $1,000 and keeping $9,000 available for a lawyer is often the better use of the money. If you do have the cash and can leave it with the court, cash costs less in the end. We will tell you that on the phone.
Frequently asked questions
Do you get bail money back if charges are dropped in Kansas?
Cash paid to the court, yes, less costs and fines. A premium paid to a bondsman, no.
How long does a cash bond refund take?
It depends on the court. Ask the clerk when the order is entered.
Can the court keep part of a cash bond?
Yes. The statute allows restitution, costs, fines and fees to come out first.
The person was found not guilty. Is the premium refunded then?
No. The result of the case does not change what the premium paid for.
Does the bond end when charges are reduced?
No. A reduced charge is still a pending case. The bond stays in force until the case is finished.
What if I paid the bond for someone else?
A cash refund goes to the person named on the receipt. See paying someone else’s bail bond.
