You can leave Kansas while on bond only if nothing in your release says you cannot. Kansas has no blanket law that keeps every person on bond inside the state line. Three sets of rules decide it: the conditions the judge wrote on the bond, the contract with your bondsman, and the rules of any supervision officer. If all three allow the trip, you can go. If any one says no and you go anyway, you risk a revoked bond and a trip back to 141 W Elm.
Case Bail Bonds is at 705 N Broadway in Wichita. If we wrote your bond, call (316) 900-1667 before you book anything.

3 permissions to check before you leave Kansas while on bond

1. The judge’s conditions
K.S.A. 22-2802 lets a judge “place restrictions on the travel, association or place of abode of the person during the period of release.” The same statute requires the appearance bond to list every condition of release. So the answer is on paper you already have.
Look for wording such as:
- Do not leave the State of Kansas
- Do not leave Sedgwick County
- Remain at the listed address
- Surrender your passport
- House arrest or GPS monitoring
If there is a travel limit and you need to go, a judge can change it. The statute allows the court to amend release conditions at any time. A defense lawyer files a short motion with the reason, the dates and the address where you will stay. Funerals, medical care, work and child custody exchanges are the usual reasons. Ask early. A motion filed on Thursday for a Friday flight rarely gets heard.
2. The bondsman’s contract
Even when the judge set no limit, your bail bond contract almost always has one. It will say something like: do not leave the state, or the county, without written consent.
The reason is money. The bondsman owes the court the full bond if you do not appear. If you are arrested in another state, the bondsman has to get you back to Wichita. Under Rule 303 of the 18th Judicial District, a surrender only counts when you are delivered to the Sedgwick County Adult Detention Facility. Under K.S.A. 22-2807, a court can also order the surety to pay the cost of returning you.
Bondsmen approve travel all the time. They want four things:
- Where you are going and the address
- The dates you leave and return
- A working phone number while you are away
- Your next court date, which you must be back for
Get the approval in writing. A text message from the office is enough to prove you asked.
3. Supervision rules
Some people are released under the supervision of a court services officer, with or without a bondsman. K.S.A. 22-2802 allows this and lets the court charge up to $15 a week for it. If you report to an officer, ask that officer too. Missing a check in because you were out of state is a violation by itself.
What happens if you leave Kansas without permission?
| What you did | What can happen |
|---|---|
| Broke a travel condition set by the judge | The court can revoke the bond. A warrant is issued and a new bond is set after arrest |
| Broke the bondsman’s contract | The bondsman can surrender you to the jail under K.S.A. 22-2809 |
| Missed a court date while away | The bond is forfeited and a warrant is issued |
| Stayed gone more than 30 days after forfeiture | A new charge of failure to appear under K.S.A. 21-5915 |
On a felony, K.S.A. 22-2807 requires the sheriff to enter the warrant into the National Crime Information Center index within 14 days. After that, a traffic stop in Tulsa or Kansas City, Missouri, shows the same warrant an officer in Wichita would see.
You also lose money. A premium is not refunded when a bond is revoked, and a new bond means a new premium. Details are in can a bondsman revoke your bond.
Common travel situations in Wichita
- Work travel. Truck drivers, aircraft workers on assignment and construction crews leave the state for work every week. Bring a letter from your employer and your schedule to the bondsman and to your lawyer.
- You live in another state. If you were arrested here while passing through on I-35 or visiting family, you will need to go home. Tell the bondsman at the start. The Sheriff notes that people from out of state generally do not qualify for release on their own recognizance unless a judge authorizes it, so a surety bond is the usual route.
- Kansas City. State Line Road is a state line. A Chiefs game at Arrowhead is in Missouri.
- A quick trip to Oklahoma. The border is about an hour south of Wichita on I-35. It still counts.
- Moving. Tell the court, your lawyer and the bondsman before you change your address, even inside Wichita.
- International travel. Expect the court to say no on a felony, and expect to be asked for your passport.
Frequently asked questions
Do airports know if you are on bond?
Airport security screens for safety threats. It does not enforce bond conditions, and there is no bond list at the checkpoint. That does not make the trip allowed. An active warrant can surface in any contact with police, and your bondsman can still surrender you when you get back.
Can you go to another county in Kansas while on bond?
Usually yes, unless the bond or the contract limits you to Sedgwick County. Read both.
Can I leave Kansas if I am on an OR bond with no bondsman?
Check the conditions on the bond. With no bondsman there is no contract to worry about, but the judge’s conditions still apply. See OR bond in Sedgwick County.
What if there is a family emergency tonight?
Call your bondsman before you leave, at any hour. We answer the phone 24 hours a day. Then call your lawyer in the morning.
What happens if I am arrested in another state while on a Kansas bond?
The new arrest can violate your Kansas bond. Call your lawyer and your bondsman right away. Kansas law lets a court set a forfeiture aside when the surety proves the person was in jail elsewhere in the United States, but you have to speak up for that to happen.
The short version
Read the bond. Ask the bondsman. Ask the officer if you have one. Get it in writing, keep your phone on and be back for court. Our pages on defendant responsibilities after bail and court dates after bail cover the rest.
